Terms of Service

These Terms of Service ("Terms") govern your use of ProveIQ (proveiq.in), operated by Talpro India ("we", "us", "our"). By using ProveIQ, you agree to these Terms.

1. Eligibility

You must be at least 16 years old to use ProveIQ. By creating an account, you represent that you meet this requirement and that the information you provide is accurate.

2. Account Types

2.1 Candidate Accounts

Free accounts that allow you to browse internships, submit work, receive AI evaluations, earn certificates, and maintain a public profile.

2.2 Employer Accounts

Accounts that allow posting internships, reviewing candidates, and accessing evaluation data. Subject to plan limits and pricing.

3. Acceptable Use

You agree NOT to:

  • Submit work created by someone else as your own (plagiarism)
  • Use AI tools (ChatGPT, etc.) to generate submissions unless explicitly allowed by the internship brief
  • Create multiple accounts to game scores or leaderboard
  • Harass, spam, or abuse other users
  • Attempt to manipulate AI evaluation scores
  • Scrape, crawl, or bulk-download platform data
  • Reverse-engineer our AI evaluation system
  • Use the platform for any unlawful purpose

4. Intellectual Property

4.1 Your Content

You retain ownership of work you submit. By submitting, you grant ProveIQ a non-exclusive, worldwide license to evaluate, display, and store your submissions for platform operations. Employers who posted the internship can view your submissions.

4.2 Our Content

ProveIQ's brand, design, AI evaluation system, and platform code are our intellectual property. You may not copy, modify, or distribute them without permission.

4.3 Employer Usage Rights

When you submit work against an Employer's brief, the Employer is granted a time-bound, non-exclusive, evaluation-only license to access, review, score, and internally circulate your submission for the express purpose of hiring decisions. This license is limited to the active evaluation window (default 90 days from submission, extendable by written agreement) and strictly excludes commercial exploitation, reproduction, sublicensing, public display, derivative-work creation, training of machine-learning models, or transfer to third parties. On expiry of the window or on candidate-initiated erasure under DPDP Act 2023 §12, the Employer's access is revoked and cached copies must be destroyed within 30 days.

4.4 Commercial Use Prohibition

No party — neither ProveIQ nor any Employer — may use candidate submissions for commercial purposes outside the evaluation scope defined in §4.3 without explicit, revocable, written consent from the candidate obtained through the ProveIQ Consent Engine. Commercial use includes, without limitation: resale, inclusion in paid products, public marketing use, AI/ML training datasets, and publication in case studies. Breach of §4.4 by an Employer terminates their license under §4.3 immediately and entitles the candidate to statutory damages under the Indian Copyright Act plus DPDP Act grievance remedies.

5. AI Evaluation

Scores are generated by AI and are indicative, not absolute. We do not guarantee that AI scores perfectly reflect your abilities. Employers may override scores. We continuously improve evaluation accuracy but make no warranty of perfection.

6. Payments (Employers)

  • Paid plans are billed monthly or annually via Razorpay
  • All prices are in INR and exclusive of applicable taxes
  • Refunds: Pro-rated refund for annual plans cancelled within 14 days
  • We reserve the right to change pricing with 30 days notice

7. Certificates

ProveIQ certificates are verified credentials issued upon internship completion. They represent that you completed the work and received the stated score. They are not academic degrees or government-recognized qualifications.

8. Termination

We may suspend or terminate accounts that violate these Terms. You may delete your account at any time. Upon termination, your submissions and scores are retained for employer reference but your profile is made private.

9. Disclaimer of Warranties

ProveIQ is provided "as is" without warranties of any kind. We do not guarantee employment outcomes, score accuracy, or uninterrupted service.

10. Limitation of Liability

To the maximum extent permitted by law, ProveIQ's total liability shall not exceed the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, or punitive damages.

11. Governing Law

These Terms are governed by the laws of India. Disputes shall be resolved in the courts of Bangalore, Karnataka.

12. Changes

We may update these Terms. Continued use after changes constitutes acceptance. Material changes will be notified via email.
